Terms and Conditions
1 Definitions
1.1 The “Supplier” is Kiko Design
1.2 The “Client(s)” refers to the person(s), firm, corporation, organization, etc entering in to agreement with Kiko
Design to secure services.
1.3 “Venue” is the operator of the location where Service(s) will be supplied by Kiko Design.
1.4 “Vendors” other third parties supplying services at the time of, or near the vicinity of Kiko Design during
supply of Service
1.5 “Third Party/Parties” any person(s), firm, corporation, organization, trust outside the Supplier and the Client.
1.6 The “Equipment” means all equipment and accessories supplied or hired by Kiko Design to the Client
1.7 “Service(s)” means the service(s), items, equipment and labour provided by Kiko Design as outlined in the
floral brief / quote.
1.8 “Floral and Styling Brief” and “Quote” are used interchangeably, these are the itemised services proposed to
be completed by the Supplier on the Event Date.
1.9 “Terms” means these Terms and Conditions.
1.10 “Cut Off Date” is 30 days prior to quoted event commencement
2 Bookings and Payment
2.1 The Supplier operates on a ‘first in, first served’ basis with event enquiries.
2.2 The Supplier reserves the right to not proceed with any enquiry for Service if quote is not confirmed with a
deposit.
2.3 Floral and Styling Briefs and Quotes provided by Kiko Design are valid for 14 days from the date provided,
after which they are subject to change. If a Floral and Styling Brief or Quote have not been provided, an
itemised invoice will be provided in place of these detailing proposed Services and this will act in lieu of the
aforementioned.
2.4 To secure booking of Kiko Design for the event date stipulated in the quote, the Supplier will gather a non-
refundable deposit of 50% (or 25% for quotes over $10,000) from the client once agreement on the Floral
and Styling Brief / Quote is reached. By paying this deposit, the Client(s) agree to the services itemised in the
Floral and Styling Brief / Quote.
2.5 Quotes must be confirmed and full payment made at least one (1) month prior to event, unless agreed
otherwise. If full payment is not made, Kiko Design reserves right to cancel the booking. It is the responsibility
of the Client to be in contact with the Supplier to arrange for any changes to the Quote and ensure the Quote
meets their needs prior to the 1 month period.
2.6 Kiko Design will rely wholly on the most recent quote provided to the Client(s), it is the responsibility of the
Client(s) to thoroughly read and confirm the contents of the quote. Kiko Design shall not be held responsible
for any errors or omissions in the quote once the booking has been confirmed and the Terms have been
accepted and/or payments made.
3 Minimum Spend for Wedding Florals
3.1 The Supplier has a minimum spend for wedding florals which is $15,000.00 exclusive of the GST component.
This is applicable to wedding florals whereby there are multiple events and locations such as ceremony
flowers, reception flowers and personal delivery. Kiko Design reserves the right to determine where this
minimum spend is applicable. For personal flowers delivery (bouquet, buttonholes, etc) consideration may be
made to proceed with Services under the $15,000.00 minimum.
4 Changes, Cancellation and Termination
4.1 Changes reducing the current Floral and Styling Brief / Quote to decrease below the minimum spend OR the
non-refundable deposit amount will not be accepted.
4.2 Should there be any material or major changes to the date and/or time, of the event, the Client(s) must
notify Kiko Design in writing as soon as possible. Kiko Design may be able to transfer the booking subject to
availability and ensuring one (1) months notice provided.
4.3 Changes to the original quote may be made up to one (1) month prior to the event. Any significant changes
made within the one (1) month period may incur a fee equivalent to 30% of any cancelled portion of the
original quote, which will be used towards the event; or require an upfront payment for any additional
cost(s).
4.4 Small changes to the original quote, such as additions, can be made up to two (2) weeks prior to the event.
Where changes are requested after this period, Kiko Design reserves the right to charge additional fees and
the Client(s) will be notified accordingly.
4.5 If any changes are made and accepted by the Supplier, the Client(s) will be provided with an amended quote
being the latest and current quote, subject to payment timeframes outlined above.
4.6 In the event of full cancellation occurring greater than one (1) month prior to the date of the event, the
Client(s) will forfeit the non-refundable deposit. Full cancellation less than one (1) month prior to the event date will forfeit 100% of the quote provided.
4.7 In the unlikely event that Kiko Design is required to cancel, or is unable to fulfill the Service(s), or any part
thereof, due to unforeseen and/or reasonable circumstances such as illness, injury, accidents, natural
disaster, unrealistic expectation; where possible, Kiko Design will refund the relevant payments made
towards the Floral and Styling Brief or Quote.
5 Floral and Product Substitution and Availability
5.1 Kiko Design will endeavour to prevent substitution, however, cannot guarantee certain flower/foliage types,
species, colours, shades, etc will be available as this is subject to seasonable changes and availabilities. Many
floral and foliage items are imported from overseas and therefore availability can be unpredictable.
5.2 The Supplier reserves the right to make substitutions should the proposed item(s) be unavailable or are not
of the quality suitable for the event. Should this occur, the Supplier will make all reasonable attempts to
maintain the proposed colour scheme and style as outlined in the Floral and Styling Brief or Quote. Kiko
Design will ensure that any changes made are of equal value to the proposed and unavailable items.
5.3 Any items such as vases, containers, pedestals, urns, easels, arches, signage, and so forth may become
unavailable due to supplier issues, misuse by previous clients, and normal wear and tear. Should this happen,
Kiko Design will contact the Client(s) to notify of such changes. However, if insufficient time to contact the
Client(s), Kiko Design reserves the right to make submissions to items as similar as possible to the agreed in
equal value.
6 Property of Kiko Design
6.1 All Equipment or Product hired and provided to the Client remains property of Kiko Design.
6.2 The Client(s) has sole responsibility of care of Equipment from the point of delivery and/or completion of set
up to the time of pickup of the goods by the Supplier.
6.3 Should any Equipment be lost, misused, broken, damaged or stolen, not including reasonable wear and tear,
the Client(s) will reimburse the Supplier for suitable replacement. The supplier will provide the Client with an
invoice and payment instructions for replacement.
6.4 Damage waiver fees are non-refundable, irrespective of whether items were damaged. It covers all costs
associated with normal wear and tear to Equipment and any accidental damage to a particular Equipment,
provided that the replacement cost and/or cost of repairs to any Equipment which was damaged, does not
exceed 10% of the hiring fee for the particular Equipment. The damage waiver does not apply to or cover any
other damage to or loss of Equipment or Equipment including, without limitation:
a) Damage resulting from overloading, exceeding rated capacity, misuse, abuse or improper servicing of
Equipment;
b) Damage or loss due to disappearance of the Equipment
c) Damage caused by the use or operation of Equipment in contravention of any of these Terms;
d) Damage to, or loss of, the Equipment from any unknown cause
7 Transportation, Delivery, Set up and Packdown
7.1 Kiko Design will deliver and set up at only the date(s), time(s) and location(s) outlined in the Floral and Styling
Brief / Quote. The Client(s) should allow approximately thirty (30) minutes from the scheduled time for any
delays that may occur outside the control of Kiko Design.
7.2 It is the responsibility of the Client(s) to provide the correct location, time and dates for events to the
Supplier. These details must be provided at least two (2) weeks prior to the event. Any changes to the
location(s), time(s), and/or date(s) from the original quote are subject to agreement by Kiko Design and may
incur additional charges.
7.3 In the event that there is no person available to receive the goods at the agreed location, the goods will be
left in as safe a location that can be accessed, and Kiko Design will contact the Client(s) or the suitable
contact person to advise where the goods have been placed. If there is no safe place available, the Supplier
reserves the right to withhold the item(s) and Service(s) for safety and security. In this case, the Client(s) will
need to arrange their own pick-up from Kiko Design and delivery to the event locations. Should the goods
need to be re-delivered, an additional fee may be incurred.
7.4 Kiko Design shall not be responsible for items supplied by the client, or third parties that are lost, damaged or
stolen on transport between locations.
7.5 Kiko Design is obligated and will adhere to policies, guidelines, and prohibitions that are set forth by the
venues and/or other vendors/contractors.
7.6 Kiko Design will require proper access and appropriate working conditions in order to fulfill the work
promised. The Client(s) has a responsibility to inform and make arrangements with all associated
vendors/contractors and venues, such as what we have been employed to do, the time required to set up on
day of the event, for Kiko Design to fully deliver its work and services as per quote.
7.7 Should Kiko Design be denied access, be delayed by the venue or any other vendors / contractors, or be
required to work in an unsafe or hazardous working environment, the Floral and Styling Brief / Quote will be
completed to the best of the Supplier’s ability. However, in extreme circumstances, if the work cannot be
completed due to no fault by the Supplier, informal and on-the-spot adjustments may need to be made to
Service(s) in order to complete the Quote.
7.8 Subsequent to completed arrangements and/or set ups, if any products are moved, altered or touched by
third parties, Kiko Design will not be liable for damages, loss, changes, personal injury and so forth.
7.9 In the event of extreme weather conditions such as extreme heat or excessive winds etc, Kiko Design is not
liable for the longevity of the flowers.
7.10 Should any goods provided by the Client(s) to the Supplier for the event be lost, damaged or stolen, Kiko
Design will not be liable.
7.11 Upon pack down of a completed Event, the Supplier will proceed to re-acquire all equipment including
vessels, structures, and items products. Non-hire items, such as florals, greenery, candles other perishables
and remnants, will be disposed of. If the client wishes to take home product such as flowers and greenery
this must be formally organized prior to the event and notarized included in the Quote.
7.12 If a pack-down is not formally organized, Kiko Design will only take back hired goods. All non-hire items such
as florals, candles, greenery, etc will be left at the venue. If the venue requires Kiko Design to take back any
items provided there may be additional charges.
7.13 Kiko Design shall not be liable for fees charged by the venue in the course of installation and bump out.
8 Confidentiality and Privacy
8.1 All Client(s) information is treated as confidential and will not be disclosed under any circumstances to other
parties without the Client’s consent.
8.2 Any quotes, contracts, or materials provided by Kiko Design shall not be disclosed or shared by the Client(s)
to third parties.
8.3 Kiko Design reserves the right to store and share any of the floral work made for purposes such as
advertisements, portfolios, social media, and/or any other purpose. If the Client(s) does not wish to share any
imagery, for example: Images containing their face, they must notify Kiko Design as soon as possible in
writing prior to the event.
8.4 Photos taken by Kiko Design remain the property of Kiko Design. Photos are not to be reproduced, copied or
edited in any way without the permission of the owner.
8.5 Kiko Design takes no responsibility for the Client’s photos being used in a way that is not permitted.
8.6 If the Client(s) would like to share any of the floral work, please credit Kiko Design.
9 Liability
9.1 The Client(s) agree and acknowledge Kiko Design is not responsible or accountable for any personal injury or
negligence resulting from use of goods supplied to the Client or on behalf of the client.
9.2 It is the Client’s responsibility to inform Kiko Design of any known nature-related allergens, including flowers,
foliage, pollen and insects.
9.3 Kiko Design will not be liable for allergic reactions or illness resulting from items, and services supplied and
products utilized in event production by the Supplier.
9.4 Flowers are natural products and therefore may carry thorns, sharp edges, bugs and/or transfer colour. Kiko
Design will endeavor to remove and prevent some such risks, however will not be liable for any injuries or
damage caused outside its control.
9.5 Kiko Design will not be liable for any direct, indirect, accidental, special consequential and/or exemplary
damage to the Client(s) or any other party, including but not limited to damages for product liability, personal
injury or negligence resulting from the provision and/or use of goods or arrangements supplied to the
Client(s) or any other party.

Miscellaneous
10.1 These Terms and Conditions may change at any time without notice, refer to kikodesign.com.au for current
and up-to-date terms.
10.2 All amounts are quoted in AUD (Australian Dollar), the Supplier will only accept payments in AUD.
